PURPOSE OF THE APPLICATION
The Owner wants to subdivide its property into 2 separate parcels of land in order to construct a new, 2½-storey semi-detached dwelling, with one half on each of the newly created parcels. The existing dwelling, garage and sheds located on the property are to be demolished.
CONSENTS ARE REQUIRED FOR THE FOLLOWING
In order to proceed, the Owner requires the Consent of the Committee for Conveyances. The property is shown as Parts 1 & 2 on a Draft 4R-Plan filed with the applications and the separate parcels would be as follows:

Approval of these Applications will have the effect of creating 2 separate parcels of land, both of which will not be in conformity with the requirements of the Zoning By-law, and therefore Minor Variance Applications (D08-02-10/A-00006 & D08-02-10/A-00007) have been filed and will be heard concurrently with these Applications.

PURPOSE OF THE APPLICATION
The Owner has filed Applications for Consent (D08-01-10/B-00008 & D08-01-10/B-00009), which if approved, will have the effect of creating 2 separate parcels of land, both of which will not be in conformity with the requirements of the Zoning By-law. Each of the newly created parcels will contain one half of the proposed new 2½-storey semi-detached dwelling, as shown on plans filed with the Committee. The existing dwelling, garage and sheds located on the property are to be demolished.
RELIEF REQUIRED
In order to proceed, the Owner requires the Authority of the Committee for Minor Variances from the Zoning By-law as follows:
A-00006: 453 Bevan Ave. (Part 1 on the Draft 4R-Plan) one half of the proposed semi-detached dwelling.
a) To permit a reduced front yard setback of 5.5 metres, whereas the By-law requires a minimum front yard setback of 6.0 metres.
b) To permit a reduced rear yard setback of 0 metres, whereas the By-law requires a minimum rear yard setback of 6.0 metres.
c) To permit a reduced rear yard area of 0 square metres (0% of the lot area), whereas the By-law requires a minimum rear yard area of 25 % of the lot area, or 58.1 square metres in this case.
* It should be noted for By-law purposes that Bevan Avenue is deemed to be the frontage for the Property.

d) To permit a reduced front yard setback of 4.5 metres, whereas the By-law requires a minimum front yard setback of 6.0 metres.
e) To permit a reduced rear yard setback of 3.25 metres, whereas the By-law requires a minimum rear yard setback of 6.0 metres.
f) To permit a reduced rear yard area of 50 square metres (22% of the lot area), whereas the By-law requires a minimum rear yard area of 25 % of the lot area, or 58.0 square metres in this case.
THE APPLICATIONS indicate that the Property is the subject of Consent Applications (D08-01-10/B-00008 & D08-01-10/B-00009) that have been filed and will be heard concurrently with these applications.

The application indicates that the Owner also wants to construct a second storey over the first storey of the existing 1-storey detached dwelling, as shown on plans filed with the Committee. RELIEF REQUIRED In order to proceed, the Owner requires the Authority of the Committee for Minor Variances from the Zoning By-law as follows: a) To permit a reduced rear yard setback of 3.41 metres, whereas the By-law requires a minimum rear yard setback of 25% of the lot depth, or 6.47 metres in this case. (b) To permit a reduced rear yard area of 51.96 square metres or 13.17% of the lot area, whereas the By-law requires a minimum rear yard area of 25% of the lot area, or 98.6 square metres in this case. THE APPLICATION indicates that the Property is not the subject of any other current application under the Planning Act. |
